DOT:O Terms of Service & End-User License Agreement - Last updated 2021-01-12
The following terms of service ("terms of service", "TOS", "terms", or similar) and end-user license agreement ("EULA", or similar) are to be followed if you ("the user", "the player", or similar) wish to use, play, register for, and/or otherwise install Defender of Texel: Online ("DOT:O", "the app", or similar) on your device. Additionally, these terms are to be agreed to and followed even if the user is simply just a member of the official DOT:O Discord server.
Please read the following terms carefully and make sure you completely agree with them and understand them before installing and using the app. Failure to agree and abide to these terms will result in a failed registration and/or forfeiture of the player's account within the app and the app's official Discord server (/FUpK4tp).
※ Please note that the app and related content (including this document) are offered primarily in English. If English is not the user's primary language, it is recommended that the user use online translation services or find someone who can translate for them before proceeding any further. Claims of language barriers or similar in regards to a breach of the TOS & EULA (or any other rules, guidelines, or similar set out for the app) will not be heard.
※ The developers of DOT:O have had no coding experience prior to commencing this project. They took the opportunity to learn and attempt to re-create the now-defunct game as a hobby. DOT:O is in no way monetized, and there is no intent to create a commercialized product from this project. Users are free to donate to help keep the servers up and running, however there is no obligation to do so and they gain no other benefit from it. As such, it can be said that DOT:O was created solely as a way to reminisce and as a tribute to the original work. We recognize the intellectual property of the original creators and claim no ownership of them. All original content (found in or included in the original "DOT: Defender of Texel" by DeNA Co., Ltd) is copyrighted to their respective owners.
※ Content (including modified to heavily-modified versions of this content) found in the original "DOT: Defender of Texel" by DeNA Co., Ltd that are used in this project consist of visual assets (images, sprites, layouts, style sheets, colour schemes, etc.), auditory assets (BGM, sound effects), textual assets (names, descriptions, numbers, etc.), and conceptual assets (gameplay concepts). All these assets were made accessible (either prior to the game shutdown on 2015-06-30 or afterwards) by various members of the community and are used within the fair dealing criteria outlined by Canadian copyright laws.

Any newly created content (not found in or included in the original "DOT: Defender of Texel" by DeNA Co., Ltd), be it code, images, characters, text, concepts, or ideas in any shape or form, in the app is copyrighted to the app's development team.
2. Intellectual property
Any newly created content (not found in, included in, or otherwise a part of the original "DOT: Defender of Texel" by DeNA Co., Ltd), be it code, images, characters, text, concepts, or ideas in any shape or form, in the app is the intellectual property of the app's development team. Any original content (found in, included in, or otherwise a part of the original "DOT: Defender of Texel" by DeNA Co., Ltd) is the intellectual property of DeNA Co., Ltd. At no point is any content found or included in the app the intellectual property of the user.
3. Accountability
Should the app cause harm, damage, danger, or otherwise put the user in any unfavorable situation, the app nor its development team is to be held responsible for any damages done. The user accepts full responsibility and will not and can not hold the app or its development team responsible under any circumstances. See also Section 4.1 Device data usage.
4. Device storage & usage
The app may store data on the user's device, including, but not limited to, cookies and/or images. By using the app the user agrees to such data storage. The app may also use data stored on the user's device to validate the user's account upon opening the app.
4.1 Device data usage
The app may use large amounts of Wi-fi and/or Mobile Data during extended times of use. It is the user's responsibility to keep these amounts in check, and should these usages cause additional charges or issues of any kind, the app's development team cannot be held responsible under any circumstances.
5. Interactions with the game server ("server", or similar)
At no point is the user allowed to interfere with the normal functioning of the DOT:O server, be it by express or otherwise. This includes actions such as, but not limited to, sending multiple or surplus requests, attempting to breach server security, and attempting to overload or overstress the server to make it inaccessible to others.
6. App and server content
The app and all server content is not open-source at this time, and is to be treated as such by the user. The only exception to this is any original content (found in, included in, or otherwise a part of the original "DOT: Defender of Texel" by DeNA Co., Ltd), which is not under the development team's control and thus must be held to the standards set out by DeNA Co., Ltd.
7. Reverse engineering
At no point is the user allowed to tamper with, attempt to tamper with, reverse engineer, attempt to reverse engineer, or otherwise modify or attempt to modify the app and/or its contents for any purpose (including personal, educational, non-malicious, or otherwise).
8. Redistribution
At no point is the user allowed to redistribute the app, be it in its entirety or its partiality. The app is to be downloaded only from the official download link provided on the app's official Discord server (/FUpK4tp). If downloaded from any other source, the app is deemed illegitimate and must be immediately uninstalled, deleted, and destroyed. The development team is not responsible for any damages caused by downloading a fraudulent application.
9. Cheating
Cheating is strictly prohibited in the app. At no point is the user allowed to cheat or attempt to cheat in conjunction with the app. Additionally, should the user exploit, attempt to exploit, or otherwise use or attempt to use any of the app's possible vulnerabilities to their advantage or to gain an unfair advantage, it falls under this Section. Should this occur, the app's development team reserves the right to close, delete, suspend, ban, or otherwise modify the user's account within the app without (prior) notice to the user or the user's consent. The app's development team has no obligation to disclose any reason for account closure.
9.1 Scripting
Should the user create or attempt to create scripts, macros, or other similar processes which give them any kind of advantage, fair or unfair, in the app, it falls under Section 9. Cheating.
9.2 Scamming
If at any point the user scams or attempts to scam within the app, the app's development team reserves the right to close, delete, suspend, ban, or otherwise modify the user's account within the app without (prior) notice to the user or the user's consent. 10. Monetary value
At no point does any content found in or included within the app have any real-world monetary value. Any attempts, be it successful or not, made by the user to buy, sell, trade, or otherwise exchange any content within the app with real-world money or currency ("real money trading", "RMT", or similar) is strictly prohibited and not possible.
11. Account responsibility
If at any point the app's development team deems the user's account or activity within or in relation to the app suspicious, malicious, harmful, or otherwise in breach of the TOS and/or EULA, they reserve the right to close, delete, suspend, ban, or otherwise modify the user's account within the app without (prior) notice to the user or the user's consent. The app's development team has no obligation to disclose any reason for account closure.
11.1 Multiple accounts
The user is allowed no more than one (1) account within the app. If the user is found to have multiple accounts, for any purpose and on any number of devices, it falls under Section 9. Cheating.
11.2 Renting and Loaning
Renting fighters and/or resources to other players or loaning fighters and/or resources from other players is considered usage of multiple accounts. If the user is found to be participating in these activities (or similar), for any purpose, it falls under Section 9. Cheating.
11.3 Account emails
The usage of disposable email addresses, temporary email addresses, or similar for account registration may result in account termination. See Section 12. Account termination. See also here for the full list of accepted email domains.
12. Account termination
Should the user's account be terminated (banned, suspended, or similar) in-game, it will not be recoverable under any circumstances unless in the case of an error made during said termination. Furthermore, should the user's associated account on the app's official Discord server be terminated (banned, suspended, or similar), the user's in-game account will also be automatically terminated (banned, suspended, or similar) without (prior) notice to the user. The app's development team has no obligation to disclose any reason for account closure.
13. Additional terms
By using the app, the user acknowledges that they have read, accepted, and will abide to the DOT:O Trade Rules & Guidelines. A copy of these guidelines can be found in the post directly below this one. The user also acknowledges that they have read, accepted, and will abide to the rules set out in the app's official Discord server.
14. Changes to TOS & EULA
The app's development team reserves the right to edit, change, or otherwise modify the terms of service and end-user license agreement at any point without (prior) notice to the user. It is the user's responsibility to keep themselves updated on the terms of service and end-user license agreement and to read and accept any new changes or modifications.
